You are a male police officer working for the State Patrol. Your supervisor, Sgt. Louise Johnson, is known for her foul language and abusive conduct toward subordinates. Several times over the last few months you have made a comment or observation to which she has responded by calling you “a dumb-ass man,” adding, “You’re a man, what do you know?” Several times during roll call the Sergeant would look out among her officers and sigh, commenting out loud, “We really need women in this job.” On several occasions the Sergeant has made sexual advances toward some of the officers, including you. You are a married man.
During your last performance review, you stated that you thought you deserved a higher rating. She responded by saying, “Well, if you want to meet me at the Holiday Inn and talk a little more about what you have done to deserve a higher rating, perhaps you can convince me!” Finally, several times she has dropped various items onto the ground as you were walking by and asked you to pick up the items.
After several months of this behavior, you approached the Sergeant and complained to her. She acted surprised and apologized. She tells you it will not happen again, and you decide not to take the complaint any further.
Several weeks go by, but then it occurred again. You were working on an investigation that culminated in the confession of the suspect. The confession was unexpected, and many were surprised at the suspect. Upon returning to the squad room, and in front of the other officers on your shift, your Sergeant states, “What did you do, promise to screw the guy if he confessed?” That was the last straw. You find a lawyer and file suit against the Sergeant, claiming hostile work environment.
Applying the facts of this hypothetical, you must answer the following questions completely:
Part A What would you cite as the basis for your lawsuit? In other words, cite the statutory regime that applies and the facts that support a violation of those statutes.
Part B What employment admonitions should the Sergeant experience if you win your lawsuit?
